1.1. The promotor is Spot2Win LTD (referred to as “we” and “us” throughout this document) (company number 11352734) and is a company registered in England and Wales and our registered office is at 9 Ross Court, Killamarsh, Sheffield, S21 1DL.
1.2. The title of the competition is Spot2Win.
1.3. Spot2Win is a skill based game in which the user is provided with an image and must chose a location on that image where they think the ball is (the Competition).
Our contract with you
2.1. These terms and conditions (Terms) apply to the competition provided by us to you for a spot the ball competition (Contract). They apply to the exclusion of any other terms that you seek to impose or incorporate, or which are implied by trade, custom, practice or course of dealing.
2.2. This Contract is the entire agreement between you and us in relation to its subject matter. You acknowledge that you have not relied on any statement, promise or representation or assurance or warranty that is not set out in the Contract.
About our Competitions
3.1. We operate online Competitions. They are a skill based game resulting in the allocation of prizes in accordance with these Terms.

How to enter
4.1. To enter spot the ball Competition apply online via our website.
4.2. In order to enter a Competition, you will need to register an account with us. You can register an account online at www.spot2win.co.uk
4.3. To register an account online you will be asked to provide contact details and to create a password or you can sign in via a social media account, such as Facebook or Twitter.
4.4. You may only register one account with us. Once your email address has been registered you will not be able to use it to create another account.
4.5. By submitting a competition entry you are agreeing to be bound by these Terms.
4.6. You must purchase a ticket via out website to enter a Competition (a Ticket).
4.7. Availability and pricing of entry to a Competition is at our discretion and will be specified when you purchase a Ticket to play.
4.8. Competition Tickets may reduce in price when multiple Tickets are purchased. This can vary in reduction and will only apply to the current games at the time the entries are made. We reserve the right to end such discounts without notice to you.
5.1. Our Competitions are open to all persons aged 18 or over (or over the age of majority in their country of residence).
5.2. The following persons are not allowed to purchase Tickets to enter Competitions: (i) our employees; (ii) members of our immediate family; (iii) our agents; or (iv) any other persons connected to us or with the creation or administration of our Competitions.
5.3. By entering into a Competition(s) you are confirming to us that you have legal capacity and authority to do so and that you are eligible to claim the prize or any prize that you might win. You confirm that you have read and understood the Terms and acknowledge and agree that you will be bound by them and any additional terms and conditions as set out in any promotional content.
5.4. By entering into a Competition(s) you confirm that you are not breaching any laws in your country of residence or the country from which you are accessing the Competition. We will not be responsible if you enter into our Competition(s) unlawfully. If you are not sure whether you are accessing our Competition(s) lawfully you should not enter the Competition and should seek advice in the country from which you are accessing our website.
5.5. We reserve the right to refuse or disqualify any incomplete entries if we have reasonable grounds for believing that you have contravened these Terms.
5.6. We will not accept Competition entries that are:
5.6.1. automatically generated by computer;
5.6.2. completed by third parties or in bulk;
5.6.3. forged or tampered with;
5.7. Tickets have a minimum and maximum depending on the game you play. This will be displayed when you choose the game to enter along with the cost of tickets.
5.8. If, in our reasonable opinion, you persistently breach the terms of this Agreement we reserve the right to disqualify you from all Competitions and to disable your account with us.
6.1. Anyone signing up as a new member of our website will be considered a New Member. We do offer new member bonuses from time to time. The promotion applicable to you, if relevant, will be the one displayed on the site at the time your account is opened.
6.2. Each individual can only create one account and can therefore only benefit from the New Member promotion scheme once. If we consider, acting reasonably, that the same individual is creating multiple accounts we will be entitled to close that account(s), disqualify the relevant member from any Competitions that they have entered and we will not award any prizes to that individual. The individual will not be entitled to the Credit.
6.3. if we consider that a New Member is not “genuine” (i.e. they are in breach of clause 5.6 of this Agreement) we reserve the right to void any entries into Competitions or to revoke any game credit earned as a result of their membership. We will also disqualify the New Member from being a prize winner.
7.1. We have Instant play and Progressive Jackpot games available.
7.1.1. Instant Play: You will receive one entry at the advertised price. If you correctly guess the exact x and y co-ordinate, you will win the top prize. If you are within the predetermined 3 circles, you will receive a percentage of your entry fee back into your account. You will not be presented with the same image twice but can play the game again with a new image, chosen at random from the bank of images available for that game.
7.1.2 Progressive Jackpot: The maximum number of tickets and cost per game will be displayed when you choose the Progressive Jackpot game. The start and end date for that particular round will be displayed also. A % of each entry will be added to the Progressive Jackpot which will be displayed on the website. At the close time and date of the Progressive Jackpot game, anyone who successfully guessed the X and Y co-ordinate of the ball will share the full Progressive Jackpot which will then be reseeded for the next game. If no player gets the exact X and Y co-ordinate, any player that correctly guesses with 5 pixels of the ball will share 10% of the Progressive Jackpot amount and the new Progresssive Jackpot game will continue with the reduced jackpot amount. If no player correctly guesses within 5 pixels of the ball, the Progressive Jackpot will continue into the next game.
How to play
8.1. When playing a Competition online via www.spot2win.co.uk or via the Apps, you must follow the on-screen instructions. You will need to deposit funds into your account in order to take part. You can do this via the Cashier section. Once you have chosen the game/s you wish to play for and the number of Tickets you will be asked to confirm the entry and the relevant funds will be taken from your account. If you have insufficient funds, you will be able to deposit more using your preferred payment method and the entries will then be confirmed.
8.2. Once the game has been played and payment taken you will receive confirmation and the entry will be considered final.
9.1. Before a game is added to the website and Apps, we allocate pre-determined co-ordinates in the games’ software marking locating where the centre of the ball is deemed to be within the relevant image. Upon the game closing the software will automatically choose the winner who has selected the co-ordinate closest to the pre-allocated co-ordinates.
9.2. If more than one player has selected the correct co-ordinate then the prize amount is shared equally depending on the type of game played.
9.3. We reserve the right at our sole discretion to extend or reduce the closing date of any Competition
10.1. Depending on the type of game, winners will be announced via our social media channels.
10.2. Our decision or the decision of the judge(s) nominated by us is final and no correspondence will be entered into.
10.3. Winnings are paid into the players Spot2Win account as cash and can be returned to the payment method previously used to deposit funds.
10.4. Before a player can withdraw funds from their Spot2Win account for the first time, they may be required to send a copy of their passport (or other photographic ID as approved by us) to us to confirm their identity, age and also to prove that if the purchase was made by credit card that the card was legally theirs or that they had authorisation to use it. Any failure to meet these obligations may result in the winner being disqualified and we will be entitled to choose an alternate winner.
10.5. Upon receipt of your identification documents as detailed in clause 10.4, any pending withdrawal will be processed within 3 to 5 working days.
11. Limitation of Liability
11.1. We accept no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering in (a) Competition(s).
11.2. We have no responsibility for any injury, damage or loss to your or any other person’s computer or device relating to or resulting from participating in or downloading any materials in connection with (a) Competition(s).
11.3 We will have no responsibility for: failed, partial or garbled computer transmissions; any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, connection failures; connection availability; the acts or omissions of any service provider; lack of internet availability; traffic congestion; or any unauthorised human act.
11.4. We will endeavour to award the prize for a Competition to the correct entrant. If a prize is awarded to an incorrect person for any reason we reserve the right, at our sole discretion, to recover the Competition prize and award it to the correct entrant.
11.5. We are not responsible for any loss or damage incurred by you that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.
11.6. We are under no obligation to provide access to Competitions. If our website is unavailable for any reason whatsoever we will not be responsible to you for any loss or damage caused s a result of the lack of access.
11.7. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; or for breach of your legal rights in relation to the products.
11.8. We are not liable for business losses. We only run the Competitions for private use. If you enter a Competition for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business
12. Ownership of Competition Entries and Intellectual Property
12.1. All Competition entries and any accompanying material submitted to us will become our property on receipt and will not be returned.
12.2. By submitting your Competition entry and any accompanying material, you agree to:
12.2.1. assign to us all your intellectual property rights with full title guarantee; and
12.2.2. waive all moral rights, in and to your Competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
12.3. You agree that we may, but are not required to, make your entry available on our website and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant to us a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the Competition entry, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry,

14.1. You can change your personal details at any time by logging into your Spot2win LTD account.
14.2. Competitions are governed by English Law and any matters relating to the Competition will be resolved under English Law. The Courts of England and Wales shall have exclusive jurisdiction over any dispute under this Agreement.
