  1. About Us


  1. 1.1. The promotor is Spot2Win LTD  (referred to as “we” and “us” throughout this document) (company number 11352734) and is a company registered  in England and Wales and our registered office is at 9 Ross Court, Killamarsh, Sheffield, S21 1DL.


  1. 1.2. The title of the competition is Spot 2 Win.


  1. 1.3. Spot 2 Win is a skill based game in which the user is provided with an image and must chose a location on that image where they think the ball is (the Competition).


  1. Our contract with you


  1. 2.1. These terms and conditions (Terms) apply to the competition provided by us to you for a spot the ball competition (Contract).  They apply to the exclusion of any other terms that you seek to impose or incorporate, or which are implied by trade, custom, practice or course of dealing.


  1. 2.2. This Contract is the entire agreement between you and us in relation to its subject matter.  You acknowledge that you have not relied on any statement, promise or representation or assurance or warranty that is not set out in the Contract.


  1. About our Competitions


  1. 3.1. We operate online Competitions.  They are a skill based game resulting in the allocation of prizes in accordance with these Terms.


  1. 3.2. Game play can be found online at www.spot2win.co.uk


  1. How to enter


  1. 4.1. To enter spot the ball Competition apply online via our website.


  1. 4.2.  In order to enter a Competition, you will need to register an account with us. You can register an account online at www.spot2win.co.uk 



  1. 4.3. To register an account online you will be asked to provide contact details and to create a password or you can sign in via a social media account, such as Facebook and Twitter.


  1. 4.4. You may only register one account with us.  Once your email address has been registered you will not be able to use it to create another account.


  1. 4.5. By submitting a competition entry you are agreeing to be bound by these Terms.  


  1. 4.6. You must purchase a ticket via out website to enter a Competition (a Ticket).


  1. 4.7. Availability and pricing of entry to a Competition is at our discretion and will be specified when you purchase a Ticket to play. 


  1. 4.8. Competition Tickets may reduce in price when multiple Tickets are purchased.  This can vary in reduction and will only apply to the current games within the basket. We reserve the right to end such discounts without notice to you.


  1. Eligibility


  1. 5.1. Our Competitions are open to all persons aged 16 or over (or over the age of majority in their country of residence).


  1. 5.2. The following persons are not allowed to purchase Tickets to enter Competitions: (i) our employees; (ii) members of our immediate family; (iii) our agents; or (iv) any other persons connected to us or with the creation or administration of our Competitions.


  1. 5.3. By entering into a Competition(s) you are confirming to us that you have legal capacity and authority to do so and that you are eligible to claim the prize or any prize that you might win.  You confirm that you have read and understood the Terms and acknowledge and agree that you will be bound by them and any additional terms and conditions as set out in any promotional content.


  1. 5.4. By entering into a Competition(s) you confirm that you are not breaching any laws in your country of residence or the country from which you are accessing the Competition.  We will not be responsible if you enter into our Competition(s) unlawfully.  If you are not sure whether you are accessing our Competition(s) lawfully you should not enter the Competition and should seek advice in the country from which you are accessing our website.


  1. 5.5. We reserve the right to refuse or disqualify any incomplete entries if we have reasonable grounds for believing that you have contravened these Terms.


  1. 5.6.  We will not accept Competition entries that are:


    1. 5.6.1. automatically generated by computer;


    1. 5.6.2. completed by third parties or in bulk;


    1. 5.6.3. forged or tampered with;


    1. 5.6.4. incomplete.


  1. 5.7. Tickets are limited to one hundred per person per game.   If we suspect anyone to be exceeding this limit we reserve the right to close the associated account, void any orders and award any game credit / prize to the next closest entrant.


  1. 5.8. If, in our reasonable opinion, you persistently breach the terms of this Agreement we reserve the right to disqualify you from all Competitions and to disable your account with us.


  1. New Members


  1. 6.1. Anyone signing up as a new member of our website will be considered a New Member.  We operate a New Member promotion scheme under which every New Member will receive £10.00 in game credit (the Credit) once they have successfully signed up to our website, created a profile and spent over £5.00 on the first game only, at which point the Credit will be allocated to the New Members’ account.


  1. 6.2. Each individual can only create one account and can therefore only benefit from the New Member promotion scheme once.  If we consider, acting reasonably, that the same individual is creating multiple accounts we will be entitled to close that account(s), disqualify the relevant member from any Competitions that they have entered and we will not award any prizes to that individual.  The individual will not be entitled to the Credit.


  1. 6.3. if we consider that a New Member is not “genuine” (i.e. they are in breach of clause 5.6 of this Agreement) we reserve the right to void any entries into Competitions or to revoke any game credit earned as a result of their membership. We will also disqualify the New Member from being a prize winner.


  1. Competition types


  1. 7.1. We will hold both “Weekly” and “Limited Ticket” Competitions which will be defined as follows:


    1. 7.1.1. The “Weekly” Competition has no maximum or minimum number of Tickets for sale.     The website will display a timer to show how long is left to enter the Competition. When the timer runs out, the Competition will close.  You will not be able to purchase Tickets once the Competition has closed. We reserve the right to extend the time remaining in the Competition and/or to extend the timer for another week.  There will be a wide range of prizes to choose from. Note that the Weekly Competition may not result in a winner every week.


    1. 7.1.2.  The “Limited Ticket” Competition is limited to a pre-determined number of Tickets for purchase by entrants. All Tickets must be sold before the Competition closes.  The website will display a timer to show how long is left to enter the Competition. If the timer runs out before all pre-determined Tickets are sold then the timer will reset for another week.  The timer will continue to reset until all Tickets are sold. We reserve the right to close the Competition early if the requisite numbers of Tickets have not been sold.  If we close the Competition early either: (i) a winner will be selected from the entrants up to the date the Competition was closed and 60% of the cash value of tickets sold for that competition will be paid out to the winner in cash; or (ii) we will refund all entrants in accordance with clause 9.5 of these Terms.  There will be one prize per Competition.


  1. How to play


  1. 8.1. When playing a Competition online via www.spot2win.co.uk you must follow the on-screen instructions. Once you have chosen the prizes you wish to play for and the number of Tickets you will be asked to provide your contact details and payment details in order to play. Please ensure you have ticked the declaration box to say you have read and understood these Terms.


  1. 8.2. Once the game has been played and payment taken you will receive confirmation by email.


  1. Competition Judgement


  1. 9.1. We reserve the right to judge the competition in two ways: (i) Pre-Game Selection; or (ii) Post Game Judged Selection.


    1. 9.1.1. Pre-Game Selection occurs when we allocate pre-determined co-ordinates in the games’ software marking locating where the centre of the ball is deemed to be within the relevant image. Upon the game closing the software will automatically choose the winner who has selected the co-ordinate closest to the pre-allocated co-ordinates.


    1. 9.1.2. Post Game judged selection occurs when a selected judge working for us decides where he or she judges the centre of the ball to be within the image once the Competition has ended. Once the judge has marked their spot the co-ordinates will be added to the game and a winner automatically selected.  The judge will not be able to see details of the Competition entries before making their judgement.


  1. 9.2. If more than one player has selected the correct co-ordinate  in either Pre-Game Selection or Post Game Judged Selection a winner will automatically be generated on a first come first served basis (i.e. the first person to have played the game and selected the correct co-ordinate will win).


  1. 9.3. Any player(s) who entered the correct co-ordinate to locate the centre of the ball but were not selected to be the winner will receive £100 of game credit (subject to a maximum of 20 entrants.  If more than 20 entrants entered the correct co-ordinates to locate the centre of the ball, the first 20 to have entered the Competition will receive the credit).


  1. 9.4. If no one has selected the correct co-ordinate for the centre of the ball the next closest entry will be deemed as the winner.  If more than one entrant is joint closest the game will automatically choose the winner by selecting the entrant who played the game first.


  1. 9.5. Should we decide to close a Competition early without selecting a winner we will refund all monies by the way of game credit to be played in subsequent Competitions.  Alternatively you can request that payment for your Ticket(s) in the Competition is fully refunded.


  1. 9.6. We reserve the right to close a Competition early and pick a winner from the Tickets purchased up to the point the Competition is closed. A cash value of 60% of the money taken during the competition will be paid to the winner.


  1. 9.7. We reserve the right at our sole discretion to extend the closing date of any Competition


  1. Winner announcement


  1. 10.1. The winner of the competition will be notified by email.  We will then follow up that notification by phone (SMS or phone call) or by post using the details provided by you when you registered with our website.


  1. 10.2. Our decision or the decision of the judge(s) nominated by us is final and no correspondence will be entered into.


  1. 10.3. The winner of the Competition will be required to send a copy of their passport (or other photographic ID as approved by us) to us to confirm their identity, age and also to prove that if the purchase was made by credit card that the card was legally theirs or that they had authorisation to use it, before any prize will be paid or delivered. Any failure to meet these obligations may result in the winner being disqualified and we will be entitled to choose an alternate winner. 


  1. 10.4. Upon receipt of your identification documents as detailed in clause 10.3 we will make arrangements with the winner to deliver the prize.


  1. 10.5. The winner will have the right to choose between the prizes available. The winner must notify us of their choice in writing and within 48 hours of being notified that they have won a prize.


  1. Prizes


  1. 11.1. There will only be one prize awarded per Competition. If an entrant has: (i) played more than once in a particular Competition;  and (ii) they have selected the same co-ordinates for each of those entries; and (iii) is selected as having identified the correct co-ordinates in that Competition, only one prize will be allocated.  Prizes will be on a  first come first served basis (i.e. the first Ticket to be purchased will be deemed the winner). If all Tickets were purchased at the same time (by different entrants) the winning prize will be selected by a blind draw.


  1. 11.2.  Prizes are subject to availability.  Should this occur an alternative prize will be supplied instead. We reserve the right to change prizes for an alternative prize (of equivalent or greater value) without notice.


  1. 11.3. Cash alternatives are available should the winner choose to take the cash value instead. The cash value is 80% of the price listed on the website at the time of playing. Prize values may change at any time due to circumstance outside of our control.  In the event that that value of a prize changes during the Competition, we reserve the right to change these value of the cash alternative without notice to reflect that change.


  1. 11.4. We reserve the right to substitute any prize on the website for cash. The cash value is 80% of the cash value listed on the website at the time of playing.


  1. 11.5. Ownership of all prizes will transfer to the winner upon delivery.


  1. 11.6. In most cases we will use a third party to deliver prizes.  


  1. 11.7. Once you have received your prize you will be responsible for insuring it.  We do not offer any insurance against our prizes.


  1. 11.8. Product warranty.  New products generally come with a manufacturer warranty. If you win a Competition the prize will be purchased in your name and you will have a direct contract with the manufacturer of the product.  Consequently all claims for breach of warranty should be directed to the manufacturer with whom you have entered into a separate contract with.


  1. 11.9. All Prizes are subject to separate terms and conditions with the prize provider which they may notify you about after receiving the prize.
  3. 11.10. We will only pay for delivery of prizes (including UK VAT) for delivery within the UK. For winners outside the UK we will pay the amount of standard delivery (including UK VAT) but excluding any further costs incurred in delivering outside the UK including but not limited to VAT), Import Duties, Registration and any other taxes or duties that may be incurred in transporting to the destination country. You will be responsible for these additional costs and we will contact you to obtain payment before the prize is delivered to you.
  5. 11.11. We cannot store or hold the chosen prize for the winner.  If we contact you to advise that you have won a Competition we will ask when would be convenient to deliver the prize to You.  We will use our reasonable endeavours to deliver the prize within the timescale advised by you, however, we cannot guarantee that a prize will be delivered at a time convenient for you and we will have no liability should a prize be delivered before or after the date that you request.  We do not offer delivery on a weekend or a Bank Holiday.  If you do not or cannot accept delivery of the prize within 30 days of winning a Competition the prize will be reallocated to the next closest entrant.


  1. 11.12. If you win a Competition you agree to take part in and/or feature in any publicity or material that we may reasonably require.


  1. Refer a Friend scheme


  1. 12.1. We operate a “Refer a Friend” scheme to reward members for referring their friends.   If you refer a friend to us you will receive a “Refer a Friend Game Credit”.


  1. 12.2. You will receive a Refer a Friend Game Credit once the friend that you refer has (i) successfully signed up as a user of our website; and (ii) that friend has spent over £5.00 using our website.  The Refer a Game Friend Credit will be made as £10.00 credit to spend on competitions on our website.


  1. 12.3. There is no limit to how many friends you can refer. However, should we feel the new members are not “genuine” (i.e. they are in breach of clause 5.6 of this Agreement) we reserve the right to void any orders, game credit earned as a result. We will also disqualify the referrer and the referee from being a prize winner in the relevant Competition.  


  1. 12.4. Any Refer a Friend Game Credit will be paid into your online account. The Refer a Friend Game Credit is not transferrable to other companies or other users and can only be used to play Competitions available on our website.


  1. Limitation of Liability


  1. 13.1. We accept no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering in (a) Competition(s).  


  1. 13.2. We have no responsibility for any injury, damage or loss to your or any other person’s computer or device relating to or resulting from participating in or downloading any materials in connection with (a) Competition(s).


  1. 13.3 We will have no responsibility for: failed, partial or garbled computer transmissions; any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, connection failures; connection availability; the acts or omissions of any service provider; lack of internet availability; traffic congestion; or any unauthorised human act.


  1. 13.4. We will endeavour to award the prize for a Competition to the correct entrant. If a prize is awarded to an incorrect person for any reason we reserve the right, at our sole discretion, to recover the Competition prize and award it to the correct entrant.


  1. 13.5. We are not responsible for any loss or damage incurred by you that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.


  1. 13.6. Our prizes are provided by third parties and those third parties will enter into a separate agreement with you should you win a Competition.  The third party prize providers will be liable for any defects or issues with prizes.  We will not be responsible for any losses, damages or costs incurred as a result of a prize.


  1. 13.7. We are under no obligation to provide access to Competitions.  If our website is unavailable for any reason whatsoever we will not be responsible to you for any loss or damage caused s a result of the lack of access.


  1. 13.8. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; or for breach of your legal rights in relation to the products.


  1. 13.9. We are not liable for business losses. We only run the Competitions for private use. If you enter a Competition for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business


  1. 13.10. We are not responsible for delays outside our control. If access to our website or delivery of a prize is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay in the receipt of a prize you have won you may contact us discuss an alternative prize.


  1. Ownership of Competition Entries and Intellectual Property


  1. 14.1. All Competition entries and any accompanying material submitted to us will become our property on receipt and will not be returned.


  1. 14.2. By submitting your Competition entry and any accompanying material, you agree to:


    1. 14.2.1. assign to us all your intellectual property rights with full title guarantee; and


    1. 14.2.2.  waive all moral rights, in and to your Competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.


  1. 14.3. You agree that we may, but are not required to, make your entry available on our website and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant to us a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the Competition entry, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry,

  1. General


  1. 16.1. You can change your personal details at any time by logging into your Spot2win LTD account.


  1. 16.2. Competitions are governed by English Law and any matters relating to the Competition will be resolved under English Law.  The Courts of England and Wales shall have exclusive jurisdiction over any dispute under this Agreement.
